About Brad

Brad focuses his practice on complex business litigation and commercial transaction representation, including representing clients in contract and insurance coverage disputes, product liability, premise liability, tort defense litigation, malpractice litigation (legal/real estate/corporate governance), and mergers and acquisitions. Brad also regularly serves as outside general counsel for many of his clients.

He also defends Fortune 500 companies, debt buyers, debt collection agencies, law firms, lending institutions, and others in class action lawsuits involving claims brought under state and federal consumer laws such as the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), and the Telephone Consumer Protection Act (TCPA).

Experience

Prevailed in restoring water rates to historical levels for a senior living facility after successfully arguing that an Arizona Domestic Water Improvement District’s rate increase violated the Fair Housing Act (FHA), Arizona State Fair Housing Act (AZFHA), and the Americans with Disabilities Act (ADA).
Prevailed at the Arizona Supreme Court, establishing a legal precedent in property law by securing recognition of a cause of action for a boundary by acquiescence and setting the elements of proof for such a claim.
Defended a full-service real estate brokerage and its agent in a malpractice case involving claims of non-disclosure and misrepresentation, resulting in a complete victory through summary judgment, with all claims dismissed. The plaintiff had sought $500,000 in damages.
Defended a nonprofit foster care organization against allegations of negligence, breach of contract, and sexual abuse, ultimately prevailing on all claims and avoiding $50 million in potential damages.
