About Jonathan
Jonathan represents financial institutions in state and federal courts, arbitration proceedings, and regulatory matters, with an emphasis on foreclosure and defense litigation in Florida and nationwide through pro hac vice admissions. He advises banks, lenders, and loan servicers on disputes involving federal consumer protection statutes, including the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Telephone Consumer Protection Act (TCPA), and Servicemembers Civil Relief Act (SCRA), as well as Florida statutes such as the FCCPA and FDUTPA.
Jonathan also handles auto finance litigation, representing clients in matters involving retail installment sales contracts, dealer disputes, wrongful repossession claims, and alleged consumer protection violations.
Areas of Focus
Experience
- Secured summary judgment and affirmed victory on appeal in a contested foreclosure by establishing that a motion for rehearing directed to the summary judgment order did not toll the time to appeal the final judgment.
- Obtained summary judgment in a contested foreclosure by demonstrating that HUD regulations were inapplicable because HUD insurance was terminated prior to the filing of the complaint.
- Won summary judgment in a contested foreclosure by proving the borrower surrendered the property in bankruptcy, barring further challenge to foreclosure.
- Achieved reversal on appeal of an ex parte involuntary dismissal by successfully arguing that the trial court violated the mortgage servicer’s due process rights.
- Exposed a large-scale foreclosure note alteration scheme and led an investigation that uncovered intentional alteration of original promissory notes in eight cases. The findings resulted in nine felony criminal charges filed by the State Attorney against the foreclosure defense counsel.
