On November 5, 2021, the Centers for Medicare & Medicaid Services (CMS) issued an emergency regulation, requiring the workforce of Medicare- and Medicaid- certified providers and suppliers to be fully vaccinated against COVID-19 in order for Medicare and Medicaid facilities to continue participation in those programs. Noncompliance with the emergency regulation may result in the termination of Medicare and Medicaid provider status and could also subject providers and suppliers to civil monetary penalties and denial of payment.

On August 21, 2015, the U.S. Court of Appeals for the District of Columbia in Home Care Association of America v. Weil reversed a lower court decision and upheld the U.S. Department of Labor's (DOL) 2013 regulatory change regarding domestic service workers who provide companionship services or live-in care.

When hospitals, healthcare entities and medical groups employ physicians and mid-level practitioners through employment agreements, they generally include a covenant not to compete/covenant not to solicit ("Restrictive Covenant") in the agreements. In Illinois, for many years, as long as the Restrictive Covenant was reasonable in terms of geographic area and duration and was necessary to protect an employer's legitimate business interest, the Restrictive Covenant was considered enforceable. The offer of initial employment or continuing employment was considered to be sufficient consideration for the Restrictive Covenant.

President Trump issued a Presidential Memorandum on August 8, 2020, directing the U.S. Secretary of the Treasury to use his authority to defer the "withholding, deposit and payment of certain tax obligations." This includes the employee share of certain payroll taxes—employee Social Security taxes and Medicare taxes—on wages or compensation paid from September 1, 2020, through December 31, 2020.

On June 8, 2017, the Centers for Medicare & Medicaid Services ("CMS") published a proposed rule that would remove the ban on pre-dispute arbitration agreements instituted in an extensive final rule (The Reform of Requirements for Long-Term Care Facilities) issued by the agency in 2016. If the proposed rule is adopted, long-term care facilities will be free to enter into pre-dispute arbitration agreements as long as certain transparency requirements are met. CMS proposes to remove the provision precluding facilities from entering into pre-dispute agreements for binding arbitration with any resident or resident's representative found at §483.70(n). Further, the agency proposes to remove the provision banning facilities from requiring residents to sign arbitration agreements as a condition of admission.

On May 22, 2020, the Illinois legislature overwhelmingly passed a bipartisan bill that creates COVID-19 workers' compensation protection for certain workers considered "essential" under the Governor's stay-at-home order. The bill provides that for COVID-19 first responders and front-line workers who are infected with the coronavirus, "the exposure and contraction shall be rebuttably presumed to have arisen out of and in the course of the employee's first responder or front-line worker employment and the injury or occupational disease shall be rebuttably presumed to be causally connected to the hazards or exposures of the employee's first responder or front-line worker employment."

The COVID-19 pandemic has forced employers across the country to rapidly make numerous and significant decisions about how to manage their business in this unprecedented time.
