On Thursday, June 20, 2019, a group of Hinshaw attorneys—Jason Winslow, Danielle Costello, Roy Bossen, and Linda Horras—presented a workshop for members of the Illinois Critical Access Hospital Network (ICAHN). Attendees for the event included compliance officers and human resources professionals from ICAHN member hospitals.

Recognizing that working remotely is here to stay, the article offers businesses advice on how to ensure nonexempt employees do not engage in compensable work after hours using their mobile devices.

Hopefully, employers are already providing a private space for nursing mothers to express milk and sufficient break time to do so as required by the Fair Labor Standards Act (FLSA). The Providing Urgent Maternal Protections for Nursing Mothers Act (PUMP Act), passed on December 29, 2022, further solidifies these requirements and makes employers liable for appropriate legal or equitable remedies under the FLSA.

The intersection between an employer's obligations under the Family & Medical Leave Act (FMLA) and its enforcement of performance standards sometimes feels fraught with fear. However, nothing in the FMLA prohibits an employer from taking action against an employee for legitimate reasons, even when that employee is on or returns from a protected leave. Those were the issues before the Seventh Circuit Court of Appeals in Anderson v. Nations Lending Corporation decided on March 9, 2022.

On November 30, 2021, a United States District Court in Kentucky enjoined the enforcement of President Biden's September 9, 2021, Executive Order 14042, mandating the COVID vaccine for federal contractors. As a result of the Kentucky decision, the government is enjoined from enforcing the vaccine mandate for federal contractors and subcontractors in Kentucky, Ohio, and Tennessee, the three states that challenged the order. The court ruled that the Executive Order exceeded the President's authority over government procurement and that the health issue the vaccine mandate sought to address was not sufficiently related to the government's interest in procuring goods and services.
