Hinshaw partner Adam Guetzow and associate Elizabeth Heredia recently co-authored a chapter in the Illinois Institute for Continuing Legal Education (IICLE) 2023 handbook titled "Long-Term Care Litigation." IICLE is the premier provider of continuing legal education in Illinois. Founded in 1961, the Institute publishes a comprehensive set of handbooks designed by and for Illinois attorneys.

Hinshaw's ​David Alfini, Adam Guetzow, and Sam Crowley will present "Ethics for Adjusters" for Genex Services on July 22, 2021. Unlawful conduct consists of acts that the insurance commissioner considers a violation of the law. Licensees who do not follow these regulations can have their licenses suspended or revoked. Alfini, Guetzow, and Crowley will discuss common regulations violations and how to avoid them.

Hinshaw's David Alfini, Aimee Delaney, and Adam Guetzow will present "COVID-19 Vaccines in Senior Living: Understanding Liability and Employment Impacts," on January 13, 2021. Provided by Assurance Agency, Ltd.'s Assurance University, the program will provide attendees with industry-related updates on the COVID-19 vaccine. Additional topics covered include considerations for establishing vaccine mandates and what's next for senior living operators.

Hinshaw & Culbertson LLP and LeadingAge Illinois will team up to present a program titled, "Illinois Home Care Services Bootcamp," on September 16, 2020. The virtual workshop is designed to give home care services operators and managers at all phases of their career a deep dive into the Illinois home care licensure program. It will also explore U.S. Department of Labor (DOL) updates involving compliance with wage and hour laws and regulations.

On June 8, 2017, the Centers for Medicare & Medicaid Services ("CMS") published a proposed rule that would remove the ban on pre-dispute arbitration agreements instituted in an extensive final rule (The Reform of Requirements for Long-Term Care Facilities) issued by the agency in 2016. If the proposed rule is adopted, long-term care facilities will be free to enter into pre-dispute arbitration agreements as long as certain transparency requirements are met. CMS proposes to remove the provision precluding facilities from entering into pre-dispute agreements for binding arbitration with any resident or resident's representative found at §483.70(n). Further, the agency proposes to remove the provision banning facilities from requiring residents to sign arbitration agreements as a condition of admission.

Illinois has now followed New Mexico, Oklahoma, Texas and Washington in passing the Authorized Electronic Monitoring in Long-Term Care Facilities Act (hereinafter the "Act"). In short, the Act allows residents or families of residents in long term care facilities to install cameras or other electronic monitoring devices. What does this new law mean for the owners and operators of long-term care facilities?
