On November 15, 2024, a federal district court in Texas struck down the U.S. Department of Labor ("DOL") Final Rule that would have made over four million additional workers eligible for overtime pay. The Final Rule significantly increased the salary threshold for white-collar workers to be exempt from overtime under the Fair Labor Standards Act ("FLSA").

On September 7, 2022 the National Labor Relations Board (NLRB or the Board) issued a new Proposed Rule governing joint employer status. The proposed rule seeks to change the standard for determining whether two collaborating employers will be considered joint employers under the National Labor Relations Act (Act). If finalized, the new rule is expected to take effect in 2023.

On June 8, 2017, the Centers for Medicare & Medicaid Services ("CMS") published a proposed rule that would remove the ban on pre-dispute arbitration agreements instituted in an extensive final rule (The Reform of Requirements for Long-Term Care Facilities) issued by the agency in 2016. If the proposed rule is adopted, long-term care facilities will be free to enter into pre-dispute arbitration agreements as long as certain transparency requirements are met. CMS proposes to remove the provision precluding facilities from entering into pre-dispute agreements for binding arbitration with any resident or resident's representative found at §483.70(n). Further, the agency proposes to remove the provision banning facilities from requiring residents to sign arbitration agreements as a condition of admission.

On Thursday, November 9, 2023, the Chicago City Council voted to approve a new paid time off ordinance, the “Chicago Paid Leave and Paid Sick and Safe Leave Ordinance.” This new ordinance replaces the Chicago Paid Sick Leave Ordinance, and employees will begin accruing time under its requirements on January 1, 2024. We break down the new requirements in a question-and-answer format.

In an effort to ensure "domestic workers" have stability in their schedules and pay, Chicago Mayor Lori Lightfoot and the Chicago Department of Business Affairs and Consumer Protection passed an ordinance that amended the general employment requirements found at Chapter 6-100 of Chicago's Municipal Code. The law took effect on January 1, 2022. The amendment requires all covered employers to provide their domestic workers with written contracts that specifically set forth the domestic worker's work schedule and wage, as agreed by the employer and domestic worker.

The Center for Disease Control (CDC) issued guidance on May 13, 2021, regarding the resumption of pre-pandemic activities for those who are fully vaccinated. Although helpful for individuals, the revised guidelines raise more unanswered questions for employers already preparing for or implementing return-to-work strategies. We review and analyze these questions, along with the guidance of the CDC and other regulatory agencies, below.
