About Tom
Tom represents architects, engineers and other design professionals in matters arising from the design and construction process. He has extensive experience handling claims of professional negligence, design defect, errors and omissions, and statutory violations. He also represents individuals and corporations in breach of contract, premises liability, and employment-related matters.
Tom provides strategic, assertive representation and strives for the best possible outcomes for his clients. He has tried jury and bench trials to verdict and has significant experience in alternative dispute resolution.
Areas of Focus
Experience
- Successfully represented architecture firm on appeal of implied warranty of habitability claim against condominium association, which sought damages in excess of $5 million for alleged design defects. Illinois appellate court affirmed dismissal of association’s claim, holding implied warranty of habitability claims do not apply to architects and other design professionals in Illinois.
- Obtained dismissal of subcontractor’s claims against architect for unjust enrichment, promissory estoppel and implied indemnity involving design and construction defects of commercial property with damages in excess of $1 million.
- Obtained summary judgment on behalf of engineering firm involving $2 million claim for breach of contract, asserting a limitation of liability provision in the parties’ contract limited plaintiff’s damages to $30,000.
- Obtained dismissal with prejudice of employment discrimination suit by college professor against college and administrators for alleged violations of Title VII of the Federal Civil Rights Act and Age Discrimination in Employment Act.
