About Courtney
A seasoned litigator, Courtney handles complex first-party property and liability coverage disputes, litigations, and high-stakes arbitrations. She frequently serves as lead trial counsel or party arbitrator, advising clients on all aspects of insurance, reinsurance, and subrogation, both domestically and internationally.
As part of her national practice, Courtney navigates clients through complex insurance claims involving catastrophic loss and business income interruption related to hurricanes, tornadoes, hail, flooding, fire, and other natural disasters. She also advises on boiler/machinery and builders' risk claims. Her knowledge of geotechnical issues is often critical in disputes involving faulty design, materials, or construction.
Courtney's nearly 30-year career began at one of the nation's largest law firms, where she handled asbestos litigation across the country, gaining early experience in both trial and appellate advocacy.
Areas of Focus
Experience
- Secured dismissal of a COVID-19 property insurance claim on behalf of an insurance client. Hinshaw was retained to defend the insurer as national coverage counsel for their COVID-19 matters. The policyholder who owns and operates a casino sought coverage for business interruption and other losses due to COVID-19 virus and government orders. The court upheld the pathogenic biological material or substance exclusion and ruled that COVID-19 did not cause physical damage. The appellate court affirmed the dismissal.
- Secured a defense verdict in a multimillion-dollar, first-party property case where the corporate policyholder sought recovery for catastrophic water loss and damage to its five-story commercial property located in the Detroit Business District. The Hinshaw team successfully argued that the policyholder failed to comply with the policy's Protective Safeguard Endorsement, and all claims were dismissed. Additionally, various costs were reimbursed to the insurer due to an offer of judgment filed before trial.
- Successfully defended against a multimillion-dollar claim filed against a large market of insurers for loss arising out of a purported explosion to a manufacturing facility.
