The judge granted the defendant’s motion for a directed verdict based on the plaintiff’s failure to prove the existence of a contract, as the plaintiff did not proffer the governing insurance policy into evidence. The judge further held that even if the plaintiff introduced the governing insurance policy, the plaintiff failed to prove its case, and under both circumstances, the defendant prevailed.
