In a legal column published by U.S. Pharmacist, Hinshaw partner Michael Dowell discussed the impact of the U.S. Supreme Court's decision in the consolidated case Ruan v. United States and Kahn v. United States. The Ruan decision ruled that the Drug Enforcement Administration (DEA) must prove beyond a reasonable doubt that a prescriber knowingly or intentionally issued a prescription that they knew or intended was not for a legitimate medical purpose in order to subject that physician to criminal penalties under the Controlled Substances Act (CSA).

He will moderate the session titled "Fraud & Abuse," which will discuss recent trends in hospital-physician transaction enforcement action judgments and settlements related to the anti-kickback statute, Stark self-referral prohibition, and False Claims Act. Attendees will learn about key valuation considerations and valuation report content requirements, as well as how to determine fair market value and commercial reasonableness. The panelists will describe the roles and responsibilities of hospital administrators, legal counsel and valuators in hospital-physician transactions. Defense counsel will discuss strategies to resolve compliance and enforcement matters with government regulators. Lastly, the panelists will outline hospital-physician transaction compliance program best practices and explain how to conduct compliance audits.

Hinshaw's Mike Dowell will present "340B Drug Program Challenges and Opportunities," on September 16, 2020 at the Nevada Primary Care Association's (NPCA) Virtual 2020 Annual Health Care Conference. The conference, which is in its 25th year, will focus on the theme of  "educating, connecting, innovating." In addition to Dowell's presentation on 340B, the event will also include programs addressing staff burnout, health center policies and procedures, mental health, social and racial justice, and quality improvement.
