Hinshaw partner Scott Seaman—co-chair of the firm's global Insurance Services Practice Group— is scheduled to co-present a CLE webinar titled "Environmental Insurance Coverage Under CGL, Property, and D&O Policies for PFASs, ESG, NRS, CERCLA, RCRA, OPA, and Others" on January 7, 2025.
Environmental insurance coverage is increasingly complex due to trends in PFAS, ESG, NRD, CERCLA, and RCRA, which create new liabilities and defenses. Policyholders typically pursue coverage through general liability and environmental policies, as well as property and D&O insurance. Significant challenges include interpreting "pollutants" in exclusions and assessing which environmental costs qualify as covered damages.
This webinar will cover the following topics:
- Emerging trends in environmental claims, including PFAS, ESG, NRD, CERCLA, and RCRA cases.
- Coverage opportunities available under commercial policies beyond traditional environmental insurance.
- Important policy exclusions and defenses, highlighting the pollution exclusion found in Commercial General Liability (CGL) policies.
- The scope of covered damages, along with strategies for apportioning costs between insurers and policyholders.
Key Takeaways:
- Strategies for maximizing coverage for environmental liabilities across various policies.
- Guidance on navigating recent case law developments related to pollution exclusions.
- Insights into environmental costs that are likely to be classified as covered damages.
