Robert Finley to Present at Fourth Annual RISE Medicare Secondary Payer Conditional Payment Forum

Hinshaw partner Robert Finley will present at the 4th Annual RISE Medicare Secondary Payer Conditional Payment Forum, scheduled to take place July 27 – 28, 2020. A virtual event this year, the Forum will focus on minimizing regulatory and legal exposure. A summary of Finley's presentations follows below.
CMS Notice of Proposed Rules Part 2: An Analysis of the Mandatory Reporting Proposed Civil Money Penalty Regulations
Finley, along with LaVonya Chapman, UnitedHealth/Optum Associate General Counsel, Settlement Solutions, will evaluate and analyze Civil Money Penalties, particularly as they relate to the conditional payment resolution process. They will also discuss proven good faith efforts to reduce or extinguish the possibility of receiving Civil Money Penalties.
Conditional Payment from Conception to Completion: Requesting Redetermination of Medicare's Demand for Reimbursement of Conditional Payments
In his second presentation, Finley is joined by Medicare Secondary Payer consultant Rose Arellano. They will provide attendees with strategies to improve consistency between arguments made throughout the dispute process and mandatory reporting data submitted to CMS in light of proposed Civil Money Penalties. Finley and Arellano will explore which strategies were successful, which were not, and examine feedback provided by the CRC and BCRC to identify best practices.
