The U.S. law firm of Hinshaw & Culbertson LLP is pleased to announce the publication of the Third Edition of its 50 State Primer on Medicaid Recovery Laws authored by Hinshaw partner Robert J. Finley. The publication is intended to provide a brief introduction to Medicaid Recovery laws and act as a practical reference guide for insurance, legal, or medical service providers on Medicaid reimbursement or subrogation claims, or Medicaid compliance issues.
First published in 2017, the new edition includes both procedural and substantive changes to individual state laws since 2019, as well as an examination of the recent United States Supreme Court decision in Gallardo v. Marstiller which decided whether the Medicaid Act permits states to seek reimbursement from settlement payments allocated for future medical care.
This guide does not contain legal advice or establish an attorney-client relationship. We recommend review of the actual language and status of each law and piece of legislation as well as continued review on an ongoing case-by-case basis and consultation with counsel as appropriate to ensure compliance.
