Hinshaw & Culbertson LLP partner, and member of the Lawyers for the Profession® group, Thomas P. McGarry was recently quoted in the article "Court Sanctions Laywer Over Witness's Improper Comments," published by the Illinois Bar Journal.
The article discusses the case in which a Chicago lawyer was fined more than $68,000 because a witness he represented made comments in violation of a court order. In the article, Mr. McGarry stated that an attorney's duty includes making sure the witness understands the limitations set by a court's order. He further says that in the case of orders in limine, lawyers should be prepared to show the witness the order, plainly discuss the topics that are off limits and identify the consequences of violating the order.
