Chicago — Thomas P. McGarry, a Hinshaw & Culbertson LLP partner was quoted in a November 20, 2013 Chicago Daily Law Bulletin article titled "ARDC to Give Cases Fresh Looks."
The article discusses a recent Supreme Court decision that dismissed a sanction against a lawyer, that has resulted in a revision of 75 to 100 cases by the Attorney Registration & Disciplinary Commission (ARDC). The resulting ruling means that attorney discipline cases must relate only to a rule violation and not civil wrongs. The article discusses how the decision has created a necessary review of 75 to 100 pending disciplinary cases to decide if action is required in response to the ruling.
Mr. McGarry discusses how the decision is a clear message as to what kind of cases the ARDC can pursue. He also talks about the ruling and says it is "a direction from the Supreme Court to the administrator to keep the ball in the fairway and to make sure the disciplinary process is used to enforce the Rules of Professional Conduct."
