The Illinois Institute of Continuing Legal Education (IICLE) released the Sixth Edition of "Wrongful-Death and Survival Actions" earlier this month. Scott Seaman, Chicago-based partner and co-chair of Hinshaw's national Insurance Services Practice Group, served as General Editor of the publication. Seaman and Chicago-based partner Philip Kujawa co-authored four of the seven chapters, addressing wrongful death actions, damages in wrongful death actions, survival actions, family member liabilities, remedies, and immunities. They also included an appendix of forms and checklists. Hinshaw partner Adam Guetzow and associates Adam Koscielski and Michael Adams also contributed to the publication.
Seaman conceived the book more than a quarter century ago, noting the need for a comprehensive, authoritative work on the subject of wrongful-death and survival actions. Practitioners have found the book to be an important resource.
As the IICLE notes:
In this handbook, experienced practitioners provide the substantive law, evidentiary rules, and damage parameters need to successfully prosecute or defend wrongful-death and survival actions in Illinois. In provides insights and useful guidance for practitioners throughout the life of the case from case intake and evaluation, to pleadings, to discovery, to trial preparation, and through the trial. It also includes examples of draft pleadings, draft discovery, and useful checklists (such as pre-filing considerations, claim information requirements, potential defenses, deposition preparation, and trial preparation lists) that can be tailored for use in various cases.
The book is available for purchase in hard copy and as an e-book on the IICLE website.
