Sina Bahadoran, a partner and co-chair of the firm's Insurance Services Practice Group in Hinshaw and Culbertson's LLP Miami office, was quoted by Law360 in an article titled, "5 Insurance Battlegrounds To Watch In Florida." The article discusses five issues to keep an eye on as the Florida Supreme Court considers how to determine insurance coverage if a policyholder suffers a loss concurrently from both covered and excluded causes.
Mr. Bahadoran discusses the evaluation of coverage in instances where an insured's loss is caused by a combination of covered and excluded cases.
If courts are forced to find coverage on an "all or nothing" basis, "that's a disadvantage to the insurer that may go beyond what was priced into the policy," according to Bahadoran.
