Scott Seaman Quoted in Law360 Article on Indiana Supreme Court Decision

Scott Seaman, a Chicago partner of Hinshaw & Culbertson's LLP, was quoted by Law360 in an article titled, "Ind. High Court Leaves Pro Rata Allocation Ruling Untouched.' The article discusses the significance of the Indiana Supreme Court decision refusing to accept for transfer the Indiana Court of Appeals decision in a dispute over coverage for injury claims asserted by workers at a Taiwanese electronics plant, which upheld pro rata allocation under more modern "those sums" policy language. Scott M. Seaman noted that the Insurance Services Organization in 1986 replaced the "all sums" language in commercial general liability policies with the phrase "those sums," while retaining but relocating the "during the policy period" limitation on damages or injuries covered by the policies.
Scott and Jason Schulze are the authors of Allocation of Losses In Complex Insurance Coverage Claims, the leading treatise of the subject, which has been cited by many courts throughout the country, including various states' supreme courts and the Court of Appeals in Thomson. The parties cited the treatise in filings before the Indiana Supreme Court.
