Hinshaw & Culbertson LLP partner Philip R. Kujawa authored an article in SecurityInfoWatch.com titled "Residential Security: War on Early Termination Fees."
The article begins with the pending class action lawsuit of Emily Hogan et al v. ADT LLC, and the alarm industry's use of early termination fee (ETF) clauses. Mr. Kujawa notes how early termination fees are important for long-term service contracts. ETFs are generally enforceable by courts, as long as, the loss associated with early termination of a service contract is difficult to calculate and he fee assessed in the contract is reasonable. Mr. Kujawa also highlights useful ETF tips and strategies for providers.
