Noah D. Fiedler, partner-in charge of the Milwaukee office and member of the Lawyers for the Profession® group at Hinshaw & Culbertson LLP, authored the article "Lessons for Law Firms on Client Intake (Perspective)" published by Bloomberg Law on June 30, 2016.
The article examines how the increasingly competitive nature of the legal services market has shifted the balance of power between lawyers and clients that has resulted in now-common client indemnification clauses included in many outside counsel guidelines (OCG), requests for proposal (RFP), or client-drafted engagement letters. In the article, Mr. Fiedler discuses that a firm can’t manage a client indemnification request unless the firm knows the request exists, explaining that the first step is to institute screening mechanisms to identify the requests, whenever they occur so that the firm and client can reach outcome that benefits both.
