Maria S. Quintero, a San Francisco-based partner in the Insurance Coverage practice at Hinshaw & Culbertson LLP, was quoted in the article "Poking Around Legal Issues Associated With Pokémon Go," published by the Claims Journal on July 18, 2016.
The article discuses the popular mobile gaming app, Pokémon Go, and the various hazards associated with playing the virtual game in the real world. Some of these hazards include players bumping into each other, distracted driving leading to car crashes and trespassing on private property. Ms. Quintero comments on the claim investigations concerning these hazards stating, "[A]djusters will need to determine the facts and circumstances of the loss in order to evaluate subrogation rights and whether there is any indication of comparative negligence."
