Hinshaw's San Francisco-based partner Maria Quintero presented as part of a panel titled, "Coverage Nightmares" at the 2017 CLM & Business Insurance Construction Conference on October 10, 2017. The panel discussed how to handle claims and litigate cases in jurisdictions that prove challenging as relates to insurance coverage and also gave tips for dealing with each hurdle.
Takeaways from the presentation included:
- It is necessary in handling a claim to know whether there is any legislation or decisional law that alters a carrier’s traditional expectation or affects a carrier’s ability to handle claims in a way that falls within its usual expectations for similar claims.
- Policy language matters and it may not mean what you’d ordinarily expect.
- Preparation and attention to detail can prevent a bad situation from turning into a nightmare.
