Larry Golub was quoted in Law360's article, "9th Circuit Buoys Policyholders in Excess Settlement Fights," published on March 22, 2017.
The article discusses a Ninth Circuit decision that follows a 25 year-old California intermediate appellate decision which held that an insurance carrier, when faced with a settlement demand above the primary carrier’s limits, must either approve a policyholder's settlement of a covered claim, take over the insured's defense from the primary, or face a lawsuit from the insured. Golub stated that the ruling "doesn't square with general principles regarding the duties of primary and excess carriers." He goes on to explain that, "[allowing] a primary carrier to artificially exhaust its limits . . . results in throwing by the wayside certain established rules."
