The article discusses how the Nevada high court is determining whether an insurer can be held liable for damages in excess of its policy limits even if it didn't act in bad faith. "[T]he primary question facing an insurer is whether there is a potential for coverage under the policy, and if there is, the insurer is supposed to defend the insured" said Mr. Golub, as he comments on questions insurers will face if the high courts decide if they can be held liable for those damages.
