The article discusses a California appeals court's recent ruling that an excess insurer forced to pay part of Warner Bros.' settlement with an injured "Green Lantern" crew member can go after a primary insurer that refused to settle within its policy limits. The panel's decision will lead primary insurers to think carefully before refusing to settle within their policy limits, "The case underscores why settlements, and not just judgments, should be able to be used to support an equitable subrogation claim. Otherwise, an insured or excess insurer wouldn't have recourse when a primary insurer improperly refuses to settle a claim within policy limits," said Mr. Golub.
