Hinshaw attorney and Great Lakes Credit and Collection Association (GLCCA) President-Elect John Ryan recently discussed the Federal Government's brief filed in the Facebook v. Duguid case on a GLCCA podcast.
At issue is "whether the definition of an 'automatic telephone dialing system' in the Telephone Consumer Protection Act of 1991 encompasses any device that can "store" and "automatically dial" telephone numbers, even if the device does not 'us[e] a random or sequential number generator.'" A brief filed by the Federal government states that they agree with Facebook's position. The U.S. Supreme Court is scheduled to hear the case in October.
In the podcast, John breaks down the history of the Facebook case, how it may play out, and the impact a ruling may have on future use of predictive dialers within the collection industry.
