Chicago-based partner Aimee Delaney was recently quoted in a Modern Healthcare article discussing the decision by some healthcare providers to mandate that their personnel get the COVID-19 vaccination.
Delaney notes that "[m]ost folks have been afraid to pull the trigger on [imposing mandatory COVID-19 vaccinations]. . . . The first question we always get is, 'Can we mandate?' Frankly, I think just as important of a question is, 'Should we mandate?' That may be the tougher question for people." She cautions that employers who mandate the vaccine ". . . have to be prepared for the consequences," adding, "[w]e have to think through ahead of time what are the consequences for noncompliance, and are we prepared to enforce those? . . . Follow through becomes very important."
