David S. Weinstein—a Miami-based partner in the Government Practice Group at Hinshaw & Culbertson LLP—appeared on the Joe Rose Show on April 4, 2018 to discuss developments in the wrongful death case brought against the estate of former Marlin's pitcher Jose Fernandez by the families of Eduardo Rivero and Emilio Macias. According to Weinstein, unless a settlement is reached, this case won't be over anytime soon and we could be hearing about it for years to come. He also discussed the feud between LeBron James and Nick Saban, focused on the University of Alabama's "Shop Talk" web series and whether it unlawfully copied protectable elements of "The Shop," produced by James's media company, Uninterrupted. Weinstein noted that talking about life in a barbershop, the focus of both shows, is hardly a new idea. In reality, it comes down to whether or not LeBron did, in fact, apply for a trademark surrounding a specific application of sitting in a barbershop.
