Hinshaw partner Carol M. Rooney recently co-authored a byline published in the Fall 2025 edition of the American Bar Association’s Tort, Trial & Insurance Practice Law Journal. Titled “Recent Developments in Appellate Advocacy,” the article provides a comprehensive survey of key decisions in the US Supreme Court’s October Term 2023, along with other appellate developments, offering practical takeaways for trial and appellate practitioners.
Carol and her co-authors examine a series of rulings in the areas of civil-rights litigation, arbitration, administrative law, and employment law. Included in their discussion is the groundbreaking Loper Bright Enterprises v. Raimondo decision, in which the Court overruled its long-standing Chevron doctrine, which required courts to defer to federal agencies’ reasonable interpretations of the statutes they administer when those statutes were ambiguous.
Carol and her co-authors also highlight proposed amendments to Federal Rule of Evidence 801 and Federal Rule of Appellate Procedure 29, which provide guidance on the use of prior inconsistent statements and enhanced obligations for amicus authorship and funding disclosure.
