Anthony E. Davis authored an article for the New York Law Journal. The article, titled "A Fresh Look at Advance Waivers," addresses the ongoing subject of advance conflicts waivers and the importance of the recent decision in of Galderma Laboratories v. Actavis Mid Atlantic, 2013 WL 655053 (N.D.Tex.). Specifically that, for the first time, the court lays out a road map for how to create an advance waiver that has a realistic prospect of being enforced—at least against a sophisticated client—even over the client's subsequent change of heart.
