Hinshaw partner Ambrose McCall recently joined the Greg and Dan Show on 1470 WMBD in a discussion about the fast-evolving landscape of social media law. He explains how companies can become entangled in social media disputes, what rights businesses actually have on these platforms, and where the First Amendment applies—and does not—particularly for government employees as compared to private-sector employees.
Ambrose also analyzes the high-profile “Superbowl of social media litigation” targeting Meta/Instagram and Google over allegedly addictive design features such as the infinite scroll. He notes how a judge ruled that plaintiffs cannot recover damages for mental health injuries caused by the content of what others post about them in social media posts. However, the design-based claims and addictiveness allegations are “fair play” to litigate.
The conversation also covers content moderation, censorship, and key communications law issues, and examines why X’s AI solution, Grok, is facing scrutiny over alleged nonconsensual sexual imagery and a lack of safeguards for users.
