Kristina Marsh Wins Summary Judgment for Personal Lines Insurer

Kristina L. Marsh, a Tampa-based partner in the Insurance Coverage practice at Hinshaw & Culbertson LLP, successfully defended a Motion for Summary Judgment and won a Cross Motion for Summary Judgment regarding the water seepage or leakage sublimit contained within an endorsement to a Homeowners Property Insurance Policy.

Ms. Marsh argued for the client that the endorsement clearly limits coverage for claims arising from water seepage and leakage perils and that it should be applied as written. She argued that the Court should not isolate a single sentence or group of words in an insurance policy and read the isolated part alone and apart from other provisions; the goal is to arrive at a reasonable interpretation of the entire policy text to accomplish its stated meaning and purpose. In the conclusion of the case, the court agreed with Ms. Marsh.
