"BAA" Humbug: Business Associate Agreements of the Future

Hinshaw & Culbertson LLP health care attorney Angela M. Rust will be a featured speaker at the Second Annual Health, Labor, and Employment Law Institute from the State Bar of Wisconsin, which will be held August 22-15, 2013 at the Kalahari Resort in the Wisconsin Dells.  Ms. Rust will be presenting on the topic, "'BAA' Humbug: Business Associate Agreements of the Future," where she will discuss how business associates (including attorneys) can now be held directly liable for HIPAA violations when they create, receive, maintain, or transmit protected health information on behalf of a covered entity or another business associate. Her session will explore new requirements under the Omnibus Final Rule for BAAs between covered entities, business associates, and subcontracting business associates, including contractual language to adopt or update now, and a discussion of what practical and legal implications may be yet to come.
