Valuing a plaintiff's claimed loss often turns on the issue of collectibility. Over the last year, the existing case law on the subject has been augmented by important decisions that provide guidance on how to analyze collectibility issues, what evidence can be considered and in what manner, who has the burden of proof, and what pretrial remedies are available. The panelists will review those recent decisions and discuss the developing principles in this significant area of legal malpractice litigation, including the impact that insurance and other collateral sources (or lack thereof) may have on assessing "collectibility."
