Selection of Independent Counsel – A 50-State Survey of the Law analyzes the law concerning insurers’ obligations to provide their insureds with counsel selected by the policyholder. For each of the 50 states, plus the District of Columbia, this publication includes a discussion, including the relevant statutes and case law, as to whether and when a conflict of interest exists where the insurance company agrees to defend subject to a reservation of rights. Each state entry also includes information concerning alternatives to fulfillment of the defense obligation and the limitations of the policyholder’s right to select counsel.
