Matt O'Hara Wins Dismissal in Case for Lack of Personal Jurisdiction
Matthew J. O'Hara, with the assistance of Leigh C. Bonsall, won dismissal of a case for lack of personal jurisdiction in the U.S. District Court for the Northern District of Illinois for Culbertson Contractors, LLC, a Mississippi-based commercial construction contractor, its owner, and a related company. The plaintiff, an aircraft manufacturer, brought claims for breach of contract, tortious interference with prospective economic advantage, and piercing the corporate veil. The court held there was no specific personal jurisdiction with regard to any of plaintiff's claims against any of our three clients. The court followed recent U.S. Supreme Court and Seventh Circuit decisions making the tests for both general and specific personal jurisdiction over out-of-state defendants more stringent.
