Marjorie Hensel focuses her practice primarily in the areas of professional liability defense representing lawyers and law firms, accountants, architects, surveyors, engineers, debt collectors, broker/dealers, insurance brokers and agents, real estate agents, travel agents, tattoo artists and cosmeticians, as well as manufacturers and title insurance companies. She also has experience in extra-contractual liability and catastrophic litigation. Ms. Hensel defends EEOC claims, and also practices in the areas of securities broker/dealer liability, where she has defended broker/dealers before self-regulatory organizations. In addition, Ms. Hensel handles securities arbitration claims before the NASD.

Ms. Hensel has a broad litigation background in both defense and plaintiff litigation. Her ability to see a case from both sides is an asset she brings to the defense of her clients at trial.

  • Tried a legal malpractice case where obtained a directed verdict for one defendant and a defense verdict for the remaining defendants and the firm.
  • Defendant granted motion for summary judgment in legal malpractice action on statute of limitations and discovery rule.
  • Obtained dismissal for shareholders of law firm in AAA arbitration dispute.
  • Represented a national grocery store chain in class action lawsuit filed in U.S. district court alleging violation of FACTA.
  • Obtained dismissal for a foreign machinery manufacturer in products liability action on the basis of forum non conveniens.
  • Defendant granted summary judgment in products liability action on basis that exercise equipment was not defectively designed.
  • Defended securities brokers in class action involving mortgage backed securities.
  • Defended accountant/financial planner in class action in case where plaintiffs claimed the products sold were unsuitable.
  • Defended officers and directors of a national racing boat organization in multistate litigation.
  • Defended class action against travel agent/planning company in US. District Court, Middle District of Florida.
Professional Background
Ms. Hensel joined Hinshaw & Culbertson LLP in October 2010. Previously she was for more than two years a shareholder with Marshall, Dennehey Warner Coleman & Goggin, in Tampa, Florida.

Ms. Hensel began her legal career in 1988, as an associate with Ferraro & Associates, P.A., in Miami, Florida. In 1996, she moved to Bleakley & McKeen, P.A., in Detroit. From 1999 to 2001, Ms. Hensel was an associate with Maddin Hauser Wartell Roth Heller, P.A., in Southfield, Michigan. She returned to Florida in 2001, and was for five years a senior associate at Butler Pappas Weihmuller Katz Craig, LLP, in Tampa, Florida. She spent one year as a partner with Litchfield Cavo, LLP, also in Tampa, before joining Marshall, Dennehey in 2008.

During law school, Ms. Hensel was a law clerk in the Legal Department of the Metro Dade County Sheriff’s Office.

Ms. Hensel is a 2005 graduate of the I.A.D.C. Trial College, which is held annually at Stanford University College of Law.

Ms. Hensel is a member of The Florida Bar. Her professional memberships also include the American Bar Association and the Hillsborough County Bar Association. She holds the AV® Peer Review Rating from Martindale-Hubbell, its highest rating for ethics and legal ability.

During her tenure as a law clerk with the Metro Dade County Sheriff’s Office, Ms. Hensel authored legal memorandum on the issue of Florida’s forfeiture statute and its constitutional implications.
