Kevin Burke is an experienced trial lawyer with litigation, advocacy and counseling skills that cross many practice areas. Based on his broad jury trial background, he provides solutions and results for clients’ most challenging cases. His practice has included representation and trials involving drug and medical device lawsuits, commercial and business disputes, construction, attorney malpractice and medical actions.
In addition, Mr. Burke is a certified mediator in the Cook County Court-Annexed Major Case Civil Mediation Program and also through Loyola University Law School Health Law Center. He has been mediating cases for 14 years and has lectured nationally and presented mock mediations at conferences.
He has also drafted sports liability limitation legislation which was enacted into law in Illinois.
A selection of Mr. Burke’s more recent representative matters includes:
- A trial to verdict of a commercial business dispute involving claims of breach of contract and intellectual property relating to the design of a manufacturing control device.
- Prepared and litigated the defense of a medical device products case involving a stereotactic radiotherapy device, and claimed brain damage. Case was successfully mediated to resolution.
- Counseled a global medical device manufacturer with regard to product risk analysis and marketing.
- Tried successfully to verdict a medical wrongful death case involving a claim for $17.4 million.
- Tried an obstetrical brain injury and death of an infant to a successful verdict.
- Mediator (selected by parties) of two separate medical negligence wrongful death cases to successful settlement.
- Defended a prominent personal injury attorney in a legal malpractice action involving an underlying trucking accident.
Mr. Burke is the Vice Chairman of Hinshaw & Culbertson LLP. In this role he works closely with the firm’s Chairman and Managing Partner to implement firm strategies and initiatives.
Mr. Burke joined Hinshaw & Culbertson LLP in March 1984. He is active in firm management and has been a member of the firm’s Management Committee since 2003. In addition, Mr. Burke serves on the firm’s Executive Committee.
Mr. Burke holds the AV® Peer Review Rating from Martindale-Hubbell, its highest rating for ethics and legal ability. He has also been recognized by his peers as a Leading Lawyer in the area of Personal Injury Defense Law for the categories of Professional Malpractice and General; ADR for Personal Injury; and Commercial Litigation.
Since 2006, Mr. Burke has been named annually to the Super Lawyer list in the area of Civil Litigation Defense by Illinois Super Lawyers magazine, and since 2008 he has been selected for inclusion in the Corporate Counsel Edition of Super Lawyers magazine.
His professional memberships include the Society of Trial Lawyers, Illinois Defense Counsel, Chicago Inn of Court, Defense Research Institute (Drug and Medical Device Committee), Illinois Bar Foundation and the American Bar Association.
Mr. Burke has authored numerous articles in professional journals and publications. He has made presentations on such topics as managed care liability; third party administrator liability; wrongful birth/life issues; obstetrical malpractice; evidence law; and the trial of a breast cancer case.
