Justin M. Fabella

Practice Focus
Justin Fabella is an experienced trial lawyer. His litigation practice emphasizes the defense of professionals in federal and state courts and disciplinary agencies. Mr. Fabella represents legal, real estate and insurance professionals, accountants and securities brokers/registered representatives in liability cases. In addition, he is experienced in handling personal injury, products liability and construction matters.

Mr. Fabella also represents mortgage lenders, servicers and investors in complex litigation involving allegations of mortgage fraud, predatory lending and/or regulatory violations relative to loan origination and servicing, including, but not limited to, claims arising under TILA, RESPA, the Fair Debt Collection Practice Act and all claims and litigation arising out of contested foreclosures.

Mr. Fabella's insurance coverage practice includes providing insurers with coverage advice in multiple jurisdictions, drafting coverage opinions and position letters to insureds, litigating declaratory judgment actions and defending insurers against claims of “bad faith.”
Professional Background
Mr. Fabella joined Hinshaw & Culbertson LLP in June 2007. Previously he was an associate at Morrison Mahoney L.L.P. for four years, in both its Boston and New York offices. From 2002 to 2003 he was an analyst in the Financial Institutions Division of American International Group (AIG) in New York City.

While still in law school, Mr. Fabella clerked for Lubin & Meyer P.C., in Boston, and was a summer intern in 2000 at the Hale and Dorr Legal Services Center of Harvard Law School.

In addition, Mr. Fabella was a voluntary defender at Suffolk’s Voluntary Defender’s Clinic, where he provided counsel for indigent clients and represented them in arraignments, bail hearings, plea agreements and trials.

In addition to his other law school accomplishments, Mr. Fabella was a member of the Dean’s List. He participated in moot court, and received the Best Brief Award in the First Year Best Brief Section Competition.

Prior to his legal career, Mr. Fabella was an operations coordinator at Aftermarket Technology Corporation, which manufactured and distributed aftermarket drive train products.

In 2008 and again in 2011, Mr. Fabella was named to the Rising Stars list in the area of Professional Liability: Defense by New England Super Lawyers magazine. This designation is reserved for only 2.5 percent of all attorneys in New England.

He is a member of the Defense Research Institute, Massachusetts Bar Association, New York State Bar Association and the Boston Bar Association.
