When underlying cases go to a trial, insurers want jurors to decide factual questions affecting coverage. Some courts requires insurers to ask these questions to avoid a subsequent coverage trial or waiver; and policyholders often object. This panel will discuss the pros and cons of using special verdict forms at trial.
