Frank Marsico concentrates his practice in the areas of construction/surety law and health care law, providing a full range of transactional and litigation services to his clients.

In the areas of construction, surety and mechanics lien law, Mr. Marsico represents owners, general contractors, subcontractors, design professionals, insurance companies and other corporate entities in litigation and transactional matters. His representation of these clients includes a wide variety of actions, including those involving breach of contract, indemnity, performance/payment bond claims, lien foreclosures, interpleader actions, conversion/imposition of constructive trust, banking law and bankruptcy. He also has extensive experience in FELA defense litigation, complex class action litigation, civil rights defense, insurance coverage, commercial and tort litigation.

In the area of health care, Mr. Marsico represents a wide variety of health professionals and organizations, including physicians, surgeons, nurses, nurse practitioners, hospitals and physician practice groups. He has extensive experience in medical malpractice defense litigation, compliance counseling and defense and Medicare false claim/qui tam litigation.

Mr. Marsico actively participates in state and federal court. His litigation experience in criminal and civil cases includes bench and jury trials, hundreds of depositions, multiple successful dispositive motions avoiding the necessity for trial and all other aspects of litigation from the initial pleadings stage through post-judgment proceedings.
Representative Cases
Mr. Marsico’s representative cases include Jimmy Harvard v. Northeast Illinois Regional Commuter Railroad Corporation, d/b/a Metra, 2011 IL App (1st) 103033-U, October 12, 2011. Appeal from the Circuit Court of Cook County, No. 08 L 4945. The Appellate Court of Illinois, First Judicial District, affirmed the Circuit Court of Cook County's granting of summary judgment in favor of Metra and against plaintiff on both counts of the complaint, and denying plaintiff's cross-motion for partial summary judgment against Metra, based upon alleged violations of the Federal Passenger Equipment Safety Standards promulgated in 49 C.F.R. Section 238.1 et. seq.
Professional Background
Mr. Marsico joined Hinshaw & Culbertson LLP in May 2000.

During law school, Mr. Marsico was a member of the DePaul University College of Law Moot Court Society’s National Appellate Team. He participated in two separate moot court competitions involving dozens of law school teams throughout the country. During his third year of law school, Mr. Marsico obtained his Supreme Court of Illinois Rule 711 license, whereby he tried 13 felony bench trials with the Cook County State’s Attorney’s Office.

He is a member of the Chicago Bar Association, the Illinois State Bar Association, the American Bar Association and the Defense Research Institute.

Mr. Marsico is a member of the Leading Lawyers Network and has been selected by his peers as a Leading Lawyer in the areas of Health Law, and Medical Malpractice Defense Law.
Publications and Presentations
Mr. Marsico has presented a variety of legal topics to physicians and hospitals, including presentations allowing physicians to earn Continuing Medical Education (CME) credit. He has also given presentations on multiple issues involving surety law.
