It places particular focus on cases involving the predominance requirement of Federal Rule of Civil Procedure 23(b)(3). This publication also briefly discusses the differing requirements of class certification with respect to a settlement class.  Additionally, it includes an analysis of the few published insurance industry class action cases in which the court reached the merits of the case.
