Hinshaw & Culbertson LLP partner Anthony E. Davis will present "Inadvertent Disclosure — The Receiving Lawyer’s Dilemma" at a live West LegalEdcenter webcast on November 16, 2015. The presentation will discuss a lawyers’ duties when they receive inadvertently transmitted information or documents from opposing counsel — or others.  It can happen so easily, and it does happen with regrettable frequency. An email is misdirected because of the "auto complete" function, inappropriate use of "Reply All" or just mistaken transmission. It can happen because an attached document contains unscrubbed metadata. However the transmission is made and whatever the source, may the receiving lawyer read the transmission?  May she forward or describe it to her client?  May she use it to her client's advantage?  Or must she stop reading, notify the sender, and return the material? Answering these questions involves the interplay of the Rules of Professional Conduct on the one hand and case law on the other – and often the two are contradictory. The subject is further complicated by the fact that, depending on which jurisdiction’s rules and laws apply, the conduct required of the receiving lawyer may be entirely different.
