Hinshaw & Culbertson LLP attorney Annmarie D'Amour will present "Risky Business: Ethically Representing A Medical Marijuana Business" at a live West LegalEdcenter webcast on September 28, 2015. Recognizing that marijuana has many medical applications, at least 23 states and the District of Columbia have adopted legislation that permits the sale and use of marijuana for medicinal purposes, and a number of states have legislation pending on the issue.  Under federal law, however, it remains a crime to grow, sell or possess marijuana for any reason, or to "aid and abet" such conduct. A lawyer who counsels a client on the requirements of, and compliance with, state law runs the risk of violating the ABA Model Rule 1.2(d). This presentation will look at how different states have analyzed the ethical boundaries of a lawyer's representation, and consider how such opinions and analysis can provide guidance for avoiding the pitfalls resulting from such representation.
