David Nightingale is an experienced trial attorney who helps companies and individuals in all aspects of construction and business law. Mr. Nightingale assists his clients in negotiating and drafting contracts, and advises them on ways to minimize their cost and risk. He also works with his clients to resolve construction, lien, surety bond, employment, collection, and workers compensation disputes before litigation becomes necessary.
When a resolution cannot be found, Mr. Nightingale has extensive experience prosecuting and defending mechanics lien, surety, construction, judgment and debt collection, tort, aviation, and workers compensation actions. Mr. Nightingale represents clients in all phases of litigation in state and federal courts, in addition to arbitration and mediation proceedings.
Mr. Nightingale also concentrates his practice in litigation with an emphasis on medical malpractice defense, representing physicians, nurses, and hospitals in complex litigation. He has experience in all stages of the litigation process, from depositions to motion practice and trials. He aggressively and diligently advocates on behalf of his clients
Mr. Nightingale joined Hinshaw & Culbertson LLP in August 2011. Since then he has obtained numerous successful outcomes for his clients. A short list of representative cases include:
- The dismissal of a $1.2 Million Mechanics Lien Complaint against his client's property and the award of attorneys' fees against the claimant on behalf of his client;
- Obtained $4 Million and $300,000 judgments against bond principals on behalf of his Surety clients.
- At trial, obtained full judgment and attorneys' fees against an obstinate property owner on behalf of a materials provider client in a Mechanics Lien dispute.
Prior to joining Hinshaw, Mr. Nightingale spent two years clerking for The Honorable Robert J. Quinn, Chancery Division, Circuit Court of Cook County, where he concentrated in mechanics liens, commercial mortgage foreclosure, construction law and commercial disputes. From 2007 to 2009, Mr. Nightingale practiced aviation and insurance defense for the law firm of Madsen Farkas and Powen, where he defended large municipal airports in commercial, insurance, real estate, and personal injury disputes.
Mr. Nightingale began his legal career in 2005 with Maciorowski, Sackmann & Ulrich, moving to Hennessy & Roach, P.C. in 2006 before joining Madsen Farkas in 2007.
In law school Mr. Nightingale was a staff member of the DePaul Business and Commercial Law Journal, served as a judicial extern to The Honorable Susan Peirson Sonderby, Bankruptcy Judge, U.S. Bankruptcy Court, Northern District of Illinois, and was elected Student Body President and Student Body Social Chairman.
Before attending law school, Mr. Nightingale worked for the late Senator Daniel Patrick Moynihan (D-NY) on the U.S. Senate Finance Committee, assisting with healthcare and tax reform, and the Balanced Budget Act. Following the Senator’s retirement, Mr. Nightingale worked as a federal lobbyist on behalf of several healthcare, welfare-to-work, and educational organizations.
