Bradley Zamczyk represents clients in personal injury claims, including automobile and e-scooter accidents, as well as product liability and wrongful death claims. In recent years, his practice has expanded to defending rideshare drivers in claims arising out of auto accidents, sexual and physical assaults, and wrongful death, as well as uninsured motorist claims arising out of rideshare accidents. In his extensive product liability practice, Brad handles numerous claims involving exercise equipment, toys, bicycles, and household products. Brad leverages his decades of wide-ranging experience and knowledge in order to provide his clients with advice and counsel aligned with their business and objectives.

Brad also has significant experience with defending professional liability claims against lawyers, insurance companies, health care providers, insurance agents and brokers, and real estate agents. In addition to his successful defense of real estate professionals in fraud and negligence trials, Brad counsels lawyers in response to state bar complaints and assists insurance industry clients with insurance bad faith and contribution claims.

His background further includes litigating premises liability, employment discrimination, defamation, environmental, and business torts cases.

Brad began his career with a firm in the San Francisco area. After a decade of bolstering his experience there, he joined Hinshaw.

Representative Matters

  • Retained as primary counsel responsible for the defense of over 200 rideshare drivers involving claims arising out of auto accidents, sexual assaults, physical assaults, and wrongful death. In handling these cases, Brad took the lead on 100s of depositions, including depositions of plaintiffs, treating doctors, experts, and other witnesses. He was also responsible for implementing litigation strategy involving law and motion, discovery, as well as expert retention and resolution strategy. To date, he has attended nearly 100 mediations and coordinated with many of the rideshare company's lawyers regarding mediation strategy and issues.
  • Successfully handled a trial spanning 20 days in Stockton Superior Court involving damages to plaintiff's blueberry crop.
  • Defended a California State Bar action seeking disbarment of attorney for mishandling settlement funds, including allegations of moral turpitude, dishonesty, or corruption. After trial, the judge rejected the State Bar's attempts at disbarment and recommended a 90 day suspension.
  • Defended a large real estate brokerage in a complex fraud and negligence claim.
  • Obtained summary judgment on the issue of causation and damages on behalf of a mid-size law firm in a contentious legal malpractice case arising out of underlying trust and estate issues.
  • Defended an international insurer in coverage and bad faith actions filed in California and London. The California Court of Appeal affirmed the trial court decision.
  • Defended an alarm monitoring company in litigation arising out of a residential fire resulting in the death of two occupants and two firefighters. The alarm monitoring company called in the fire on a non-emergency line and reported an alarm, not a fire in progress. Through extensive investigation and discovery, including over 30 depositions, established that the company who sold and installed the alarm to the homeowner was contractually responsible for the majority of the damages arising out of the various wrongful death claims.
  • Successful petition to the California Supreme Court in Vandenberg v. Superior Court (1999) 21 Cal.4th 815, discussing the applicability of collateral estoppel to findings in commercial arbitration and the scope of coverage for contractual damages.

Personal

Brad lives in Mill Valley, California, where he enjoys spending time with his daughter and wife.

A four-year member of the U.C. Berkeley track and cross country teams, Brad ran the 800 and 1500 meters at the World Maccabiah Games as a U.S. Maccabiah Track and Field Team member. He still runs every morning.
