Adam L. Saper

Adam Saper focuses his practice in litigation, arbitration and mediation of complex business, securities, and employment disputes.

In the area of contract disputes and business torts, Mr. Saper has represented employers, manufacturers, distributors, financial institutions, technology service providers, hospitals, insurance companies and other businesses. He also has extensive experience representing both majority and minority shareholders in disputes involving closely held companies, including the prosecution and defense of claims for breach of buy-sell and other shareholder agreements and claims for breach of fiduciary duty and oppression.

In the area of securities disputes, Mr. Saper has represented broker-dealers and registered representatives in the defense of a variety of securities-related claims, including those alleging unsuitable investment recommendations, improper sales practices, negligent supervision, blue sky violations, churning, breach of fiduciary duty and breach of contract. He has represented these parties in numerous arbitrations before the National Association of Securities Dealers, now known as the Financial Industry Regulatory Authority.

Mr. Saper has extensive experience in obtaining injunctive relief in both state and federal court. He has represented employers in cases involving the breach of restrictive covenants and misappropriation of trade secrets by former employees and officers. Mr. Saper has obtained temporary restraining orders and preliminary and permanent injunctions enforcing restrictive covenants on behalf of employers against former employees, including physicians, brokers, and salespersons. He has also obtained injunctive relief in a variety of other contexts, including enjoining a technology company from abandoning a Y2K project; prohibiting a medical practice from refusing to treat patients covered by a managed care company; preventing the manager of a hedge fund from transferring fund assets; and enjoining various other acts and omissions of directors and officers of closely held companies.

In the area of employment law, Mr. Saper has represented employers in state court, federal court and administrative agencies in arbitration and mediation matters involving a broad range of employment laws, including Title VII, ADA, ADEA, FMLA, FLSA, Illinois Human Rights Act, and the Illinois Wage Payment and Collection Act.
Professional Background
Mr. Saper joined Hinshaw & Culbertson LLP as a law clerk while still in law school. He joined the firm as an Associate in August 1998.

Throughout both undergraduate and law school, Mr. Saper was a member of the Dean's List every quarter and semester, respectively. In law school he was a staff editor of The John Marshall Law Review, and the recipient of both the Edward D. Rosenberg Scholarship and the Edith and Philip Baim Scholarship.

Mr. Saper serves as an adjunct professor of legal writing at The John Marshall Law School.
